President dismisses plea for disqualification of 27 AAP MLAs
New Delhi: In a huge relief to the Aam Aadmi Party, President Ram Nath Kovind on Thursday dismissed as “not maintainable’’ a plea to disqualify 27 ruling party MLAs of the Delhi government who were charged with holding office of profit by occupying the office of the chairperson of Rogi Kalyan Samitis attached to various city hospitals.
Dismissing the plea, President Ram Nath Kovind quoted in his order — a copy of which is available with the UNI — the opinion of the Election Commission of India that said that Chandni Chowk MLA Alka Lamba, and 26 other members of the Delhi Legislative Assembly against whom the plea was made, “have not incurred any disqualification under section 15 (4) of the Government of the National Capital Territory Act, 1991, for holding office of profit in view of item 14 of the Schedule of the Delhi members of Legislative Assembly (Removal of Disqualification) Act, 1997.’’
The Election Commission had said that the Rogi Kalyan Samitis constituted by the Government of the National Capital Territory of Delhi and their Chairpersons were not entitled to any remuneration, and would, therefore, fall under the exemption granted by item 14 of the Schedule of the Delhi Members of Legislative Assembly (Removal of Disqualifictaion) Act, 1997.
Exercising the powers conferred on him, the President held that the petition of June 21, 2016 filed by (complainant advocate) Vibhor Anand, on the question of alleged disqualification of Ms. Alka Lamba and 26 other members of the Delhi Assembly “is not maintainable’’ and dismissed the plea.
The AAP was quick to rejoice and reiterated, “Woh pareshan karke rahe, hum kaam karte rahe (“they kept troubling us, we kept working’’).
