High court legal services to organise National Lok Adalat on July, 10
'Litigants interested in settlement may approach front office HCLSC'
Srinagar, June 29: The High Court Legal Services Committee is organizing National Lok Adalat on 10th July, 2021.
Officials informed news agency KINS that the Lok Adalat will be organised in both the wings of the High Court of Jammu and Kashmir physically and virtually.
“The cases shall be taken up for settlement in pre-Lok Adalat sittings and final disposal in National Lok Adalat,” they informed.
Cases that may be taken up for settlement in the aforesaid National Lok Adalat include Cheque cases under Negotiable Instruments Act , Bank recovery cases , Labour dispute cases, Electricity and water bill disputes (Excluding non-compoundable).
“Other cases including Criminal-compoundable, Matrimonial and Civil disputes Pending cases (reflected on National Judicial Data Grid) Criminal compoundable cases Cheque cases under N.I. Act Bank recovery cases MACT Labour dispute cases, Electricity and water bill disputes (excluding non-compoundable), Matrimonial disputes, Land Acquisition cases. Service matters relating to pay and allowances as well as retirement. Benefits Revenue cases, civil cases involving disputes of rent, easement rights, specific performance of contracts and injunction suits”.
The Litigants whose cases are pending and are interested in settlement of his/her case/dispute through Lok Adalat, may approach the front office High Court Legal Services Committee Jammu/Srinagar with the details of his/her case (title, cases number and date of hearing) to be listed before the National Lok Adalat.
Lok Adalat (People’s Court) is one of the Alternative dispute resolution mechanisms in India.
It is a forum where cases pending on panchayat or at pre litigation stage in a court of law are settled. It has been given statutory status under the Legal Services Authorities Act, 1987. Under this Act, the award (decision) made by the Lok Adalats is deemed to be a civil court case and is final and binding on all parties.
No appeal against such an award lies before any court of law. If the parties are not satisfied with the award of the Lok Adalat (though there is no provision for an appeal against such an award), they are free to initiate litigation by approaching the court of appropriate jurisdiction.
It is to mention here that the Supreme Court Judge, Justice Uday Umesh Lalit & Executive Chairman, NALSA has said that “Due to the Covid Pandemic, functioning in courts has been severely affected and only urgent matters are taken up.
This has put a tremendous amount of burden on the courts, adding to an already heavy docket in courts. Lok Adalats are essential to shed such unwanted burden with respect to cases that can be easily disposed of. The aim of this webinar is to guide Legal Services Authorities in such a way so as to maximise the effort put in and get the best results possible. My endeavour is to speak to you and galvanise the entire apparatus in action, to ensure whatever is possible on 10th July, is carried out,” he has said.(KINS)
