Tangmarg Man sentenced in a 11-year-old death case of teenager
Court of JMIC Tangmarg Presided over by Towfeel Ah Mir (KCS) today Convicted a person Riyaz Ahmad Dar S/o Abdul Khaliq Dar of Shrai Tangmarg to Imprisonment under section 304-A and sec 279 RPC involved in case FIR No : 90/2012 of P/S Kunzer for a period of one year and fine of Rs.50000.
Dar was involved in the death of a 22-year-old young man Namely Bilal Ahmad Magray in the year 2012 in a Nallah at Shrai Tangmarg falling under police Sub Division Tangmarg and since then the family of victim was awaiting justice which has been delivered today.
The charge sheet in the case was presented in the year 2012.
The Victims family and U.T was represented by Senior Prosecuting Officer Saalim Javid Shah and during the course of Trial spread over 11 years Prosecution had adduced and recorded the statement of 8 Eye witnesses and all of the witnesses had stated that the accused person namely Riyaz Ahmad Dar was Responsible for the Killing of the victim namely who was of the age of 22 yrs. in the year 2012.
While pronouncing the judgement the Court reiterated that the Prosecution has succeeded in establishing beyond any shadow of doubt that the Accused has committed the grave offence which had caused the death of the Victim who was merely of the age of 22 and so young to die in that age . The Act of the Accused has been proved to have been committed and as such the accused person is Convicted for the offences under section 304-A Rpc and 279 Rpc .
The Prosecuting Officer in the case Saalim Javid told ……that in these times when almost every day a news is heard about a murder or accident being committed in the society either by adults or teenagers this judgement and verdict will act as a deterrence and the faith of people in the judicial system will be strengthened more and more and all the stake holders of Criminal Justice system must come together to improve the scenario of increase in crime rates.
The crime rate is influenced by deterrence in an inverse manner .Terming the conviction as ground breaking Javid said that this order sends a strong message that anyone involved in crimes against society will not be spared from the ambit of legal proceedings and also hailed the efforts of Investigating Agency who have Meticulously investigated the case.
The overall Supervision of the Prosecution Trial was been conducted by Deputy Director Prosecution Baramulla Mr Mohammad Ashraf Bakshi.
