Bandipora murder case: Six under trial accused will walk free after already spending conviction period in jail
Bandipora, Nov 26: A local court here in Bandipora has directed authorities to release six under trial murder accused men as they have already spent the desired time in the jail since 2012. The seventh man who is also the main accused, languishing in District Jail Baramulla shall have to spent one and a half month more in prison.
Police had arrested seven persons in connection with the murder of a man Niagar Sidiq Dar, a resident of Laharwalpora village of North Kashmir’s Bandipora district in 2012.
Nigar was killed after a feud between villagers from Chringpora and Laharwalpora over sand extraction issue.
Shortly after the murder and subsequent investigation, police had arrested seven persons including the main accused Ghulam Hasan Dar.
The court of Principal District and Sessions judge Bandipora in its judgment maintained that six out of seven accused should be set free as they have already spent the desired time in the jail while the main accused should be set free after one and a half month.
All the seven accused were behind the bars since 2012, however, the main accused was on bail for over 2 months in 2016.
One of the lawyers present in the court told news agency Kashmir News Trust that in actual terms, the court convicted all the 7 accused for a period of 9 years and since they have already spent the required time in the jail they will be set free while main accused has still to serve over a month in the jail.
The court also imposed a fine of Rs 1.5 lakh on the main accused and maintained that in case of default of the payment of fine, the accused shall undergo further imprisonment of 10 years. (KNT)
