Lakhimpur violence accused Ashish Misra got bail but can’t walk out of jail. Here’s why
On Thursday, BJP leader and Union minister Ajay Misra Teni’s son Ashish Misra was granted bail by the Allahabad High Court in the Lakhimpur Kheri violence case in which he is the main accused. He was arrested on October 9, 2021.
However, Ashish Misra cannot walk out of jail just yet.
WHY ASHISH MISRA MUST REMAIN IN JAIL
In the chargesheet filed by the Lakhimpur Police, Ashish Misra has been accused under sections 147, 148, 149, 302, 307, 326, 34, 427 and 120B of the Indian Penal Code. Additionally, he has been charged under relevant sections of the Arms Act.
However, the bail order issued by the high court makes no mention of sections 302 and 120B. While Section 302 pertains to murder, Section 120B deals with criminal conspiracy.
Since these two sections have been omitted from the bail order, Ashish Misra cannot be released.
WHAT NEXT?
Ashish Misra’s lawyer will be appealing to the high court to add the two remaining sections to the bail order.
LAKHIMPUR KHERI CASE
Eight people, including four farmers, were killed on October 3 after violence erupted in Uttar Pradesh’s Lakhimpur Kheri.
The incident occurred at a farmers’ protest ahead of a visit to Lakhimpur by Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya. It has been alleged that a car with Ashish Misra in it ran over the protesting farmers, killing four of them. In the violence that ensued, another four people died. (India Today)
