Kathua rape case: Confrontation brews

New Delhi, Apr 13 : Amid a brewing confrontation, the Supreme Court on Friday affirmed that every party before any court is entitled to engage a lawyer.

If this principle is opposed, the apex court ruled, then it would be destructive of the justice dispensation system.
The Supreme Court issued notice to the Bar Council of India, Jammu and Kashmir Bar Association, Jammu High Court Bar Association and Kathua Bar Association on a plea by a group of lawyers opposing the stand of advocates in the Kathua rape case.
Kathua district bar association and state HC bar association of Jammu had gone on strike and opposed the filing of the charge sheet in the Kathua rape case.
A bench, headed by Chief Justice of India Dipak Misra and also comprising Justices A M Khanwilkar and D Y Chandrachud, sought by April 19 the detailed replies from all the respective respondents.
J&K standing counsel M Shoeb Alam told the apex court that the state police after a thorough investigation had already filed a charge sheet against the accused after producing them at the Magistrate’s residence because of the agitation.
Alam said J&K police have also registered a First Information Report against some lawyers for an attempt to prevent police from filing the charge sheet in the Kathua rape case. (UNI)
