Court Extends Judicial Remand Of Suspended DYSP, Others

JAMMU, Feb 20(JNF): Special Judge NIA Jammu Subhash C Gupta Thursday, while accepting the prayer of NIA, extended 15-day judicial remand of suspended DySP Devinder Singh and other four accused.
Besides, Devinder Singh, son of Deedar Singh resident of Overigund, Tral, Pulwama J&K, other four accused whose judicial remand was extended, included Syed Naveed Mushtaq Shah alias Naveed Baba, son of Syed Mushtaq Ahmad Shah, resident of Nazneepora, Keegam Shopian, J&K, Irfan Safi Mir, son of late Mohammed Shafi Mir resident of House No 44, Diaroo Keegam, Shopian, J&K, Rafi Ahmed Rather son of Abdul Rashid Rather resident of Batpora/Herpora Police Station Imam Sahib Shopian, J&K and Syed Irfan Ahmad @ Irfan, 26, son of Syed Mushtaq Ahmed, resident of Nazneenpora, district Shopian, J&K.
Earlier the accused–Devinder Singh was produced before the court from the Sub-Jail, Hiranagar, whereas other accused namely Syed Naveed Mushtaq Shah alias Naveed Babu alias Babar, Irfan Shafi Mir, Rafi Ahmed Rather and Syed Irfan Ahmed alias Irfan were produced from the Central Jail, Kot Bhalwal Jammu, through video conference.
Earlier the court had observed, “The perusal and consideration of the relevant entries of the CD file, reveals that the case relates to ferrying of two HM terrorists (accused) namely – Syed Naveed Mushtaq Shah and Rafi Ahmed Rather under the earlier hatched criminal conspiracy with their associates, co-accused namely DySP Devinder Singh and Irfan Shafi Mir towards Jammu, on January 11,2020 in a Hyundai I-20 car bearing registration No JK-03H-1738.
“On getting specific information, they were apprehended at Mir Bazar, Qazigund by the J&K Police. During search of the afore referred car, one AK-47, 3 pistols, 5 hand grenades, 174 live rounds of AK-47 and 36 live rounds of pistol and other incriminating material were recovered from the same. On this basis, a case FIR No 5/2020 u/s 18, 19,20,38&39 of UA(P) Act, section 7/25 of Arms Act and section 3/4 of Explosive Substances Act was registered with the Police Station Qazigund,” the court had held.
Subsequently, in compliance to the order No. 11011/10/2020/NIA dated 17.01.2020, issued by the Ministry of Home Affairs, Government of India, New Delhi, NIA Branch office Jammu re-registered a case No. RC-01/2020/NIA/JMU dated 17.01.2020 and thereafter, immediately, set the investigation into motion.
On January 23,2020, in the currency of the investigation, Syed Irfan Ahmad alias Irfan was arrested for his role in the larger conspiracy and being a harbourer of the militants.
“It further surfaced in the investigation that Syed Irfan Ahmed is younger brother of accused- Syed Naveed Mustaq Shah and is instrumental in acting as a go- between him and DySP Devinder Singh for facilitating their travel for specific mission, in pursuance of their earlier hatched criminal conspiracy, in the matter. It was further mentioned in the application that in the currency of investigation, on February 10,2020, one more accused namely – Tanveer Ahmed Wani was arrested and was produced before this court for police remand. It was further incorporated in the application that this court sent him 15 days to NIA custody on police remand,” the judge observed.
Court further observed, “Keeping in view the facts and the circumstances of the case, gravity and heinousness of the crime as involved in the present matter, submissions made by the CIO of the NIA and the stage of the investigation of the case, the court is of the considered opinion that remanding of the accused to further judicial custody as prayed by the NIA through the medium of the present application is imperative for completion of the ongoing investigation.”
“Accordingly, the prayer made by the NIA seems to be genuine and justified. Hence, the application made by CIO, NIA, in the matter for judicial remand, is allowed for fifteen days. Accordingly, ordered. The jail authority is directed to have the medical examination of the accused, on need basis and in accordance with jail manual, during the remand period. The accused, who are remanded are apprised of their rights to engage legal counsels and to have advice from them, in the matter,” the court further held.
