The High Court of Jammu & Kashmir and Ladakh has refused to quash criminal proceedings against representatives of Banaskantha District Cooperative Milk Producers’ Union Ltd, associated with the Amul brand, in a case related to an allegedly unsafe milk sample.
Justice Wasim Sadiq Nargal dismissed the petition challenging proceedings before the Chief Judicial Magistrate (CJM), Shopian, and directed the trial court to conclude the case preferably within six months.
The case pertains to a sample of “Amul Taza Homogenized Toned Milk” collected in Shopian. While an initial laboratory report declared the sample standard, a Referral Food Laboratory at NDDB Anand later termed it “unsafe” after further testing.
The court held that public health concerns outweigh commercial interests and observed that allegations involving unsafe food products must be examined during trial. It also ruled that issues relating to responsibility and negligence could only be determined through evidence during proceedings.
The High Court directed both parties to appear before the CJM Shopian on July 10, 2026.
